Role Overview

Fisker Inc is currently seeking a NHTSA and Regulatory Counsel to join our Legal team! This attorney will report to the VP of Legal for Commercial Affairs. The NHTSA and Regulatory Counsel is responsible for issues involving the Motor Vehicle Safety Act, National Highway Traffic Safety Administration (NHTSA), quality, and product safety issues. This attorney provides advice on compliance with regulatory requirements and supports the Company’s strategic objectives by providing regulatory support for Fisker.  The role could be resident in either California or Southeast Michigan, though additional remote locations will be considered for the right candidate.

Responsibilities

•Advise Fisker engineers, government relations staff, and management on federal and state motor-vehicle safety laws, regulations, and policies applicable to battery operated vehicles. 

•Represent Fisker before federal and state administrative agencies in technical meetings, investigations, and enforcement matters. 

•Advise the company on internal compliance, policy, and strategy matters. 

•Devise and conduct training programs for Fisker employees related to safety regulations and reporting.

•Work with Fisker government relations and public-policy personnel to advise the company on proposed motor vehicle safety laws and regulations and assist in the preparation of Fisker and industry comments in federal and state rulemaking proceedings. 

•Advise corporate clients on compliance with the Motor Vehicle Safety Act, NHTSA regulations, TREAD Act reporting, and recall and field action implementation.

•Advise in connection with the establishment or revision of regulatory compliance strategies to ensure compliance with international, federal, state and local laws and regulations, including FMVSS, FMSCR, TREAD Act, CAFE, Clean Air Act, CARB and similar programs

•Anticipate, identify and influence new legislation, policy or regulations that may help or hinder Fisker’s mission and the introduction of EVs 

•Cross team with various Fisker teams, including Homologation, Legal, Strategy, Engineering, ADAS and others to ensure not only compliance but the methods by which Fisker can proactively utilize laws and regulations to support EV and AV proliferation

•Review and comment on technical publications, owner’s manuals, and other customer-facing materials from a regulatory perspective

•Monitor and interpret legislative, regulatory, administrative, and judicial developments that may have an impact on product development, manufacture, and performance requirements.

•Perform special projects and demonstrate leadership ability on a wide range of issues.

•Manage outside counsel and regulatory legal budget.

Basic Qualifications / Knowledge / Experience

•Juris Doctor degree with from an ABA accredited law school. 

•Familiarity with the following areas of law: Motor Vehicle Safety, product liability, product quality, and product safety.

•Experience representing corporations to a variety of governmental authorities.

•5 to 10+ years of regulatory experience in government, corporate in-house and/or a with a large firm dealing with laws and regulations impacting the automotive industry

•Familiarity with transportation legal and regulatory issues

•Thorough understanding of transportation policy and regulatory processes

•Proven track record of working autonomously in a fast-paced and dynamic atmosphere with the ability to work cooperatively with a diverse group of partners and stakeholders both internally and externally

•Demonstrated ability to multi-task on diverse issues simultaneously

•Familiarity with more than a single country’s laws and regulations impacting the EV industry and experience in working with multiple jurisdiction regulatory agencies (e.g., U.S., Europe, China)

•Direct experience addressing electric vehicle quality, product integrity, or external investigations (e.g., crash investigations) at a federal or international level

•Prior experience working in the automotive industry in legal or engineering

•Demonstrated capability in multiple regulatory disciplines (e.g., USDOT, NHTSA, IIHS, EPA, FCC, FTC)

•Direct experience with a technology startup organization
