Role Overview
The Counsel, Marketing will report to the Vice President, Legal – Commercial Transactions and primarily support a dynamic and experienced marketing and branding team in bringing Fisker vehicles and customer experience directly to consumers.
What You’ll Do
- Provide proactive, strategic counsel to marketing clients around a variety of marketing, privacy and advertising practices with a concentration in direct-to-consumer marketing and sales through online and app based initiatives.
- Partner with marketing operations and IT clients to operationalize privacy and legal compliance on a global level.
- Provide support in establishing customer experience centers and direct to consumer automotive sales arrangements in several regions.
- Draft and negotiate a wide variety of advertising and marketing agreements, including releases and licenses, automotive show lease arrangements, talent and influencer agreements, sponsorships, and vendor contracts related to media buying and advertising technologies.
- Proactively develop and drive strategic projects and initiatives aimed at improving efficiency and effectiveness of legal services and proactive risk management, including through new templates, trainings, and processes , and building a legal playbook.
- Prepare and conduct training for managers and employees on relevant legal topics.
- Become an active partner with Marketing leadership by building key relationships, responding promptly, and being proactive about guiding the business in a way that minimizes risk and maintains company goals.
Qualifications
- JD from an accredited law school and admitted to practice in at least one US jurisdiction.
- 5-7 years of experience in commercial/technology law supporting marketing clients, preferably in a high-tech industry.
- Subject matter expertise in global marketing, consumer protection and privacy laws and standards, including Section 5 of the FTC Act, state UDAPs, CAN-SPAM, TCPA, GPDR and CCPA.
- Experience drafting, negotiating and advising on advertising and marketing agreements.
- A working knowledge of data issues, data monetization and digital advertising ecosystem.
- Ability to work quickly and adapt in a fluid, fast paced environment.
- Able to deal with ambiguity and develop creative and pragmatic solutions for complex and revolving issues in a rapidly changing environment.
- Ability to build positive and respectful relationships internally and externally and develop collaborative working relationships in a team environment.
